On August 16, Beijing Municipal Commission of housing and urban rural development officially issued the notice on further regulating the sales of new commercial housing.
In view of the problems and opinions of over decoration of model rooms and over beautification of real estate display by development enterprises for a period of time, resulting in “wrong goods” and “serious reduction of distribution” among house buyers, Beijing Municipal Commission of housing and urban rural development previously studied and drafted the notice on Further Regulating the sales of new commercial housing, and solicited opinions from the public from July 9 to 16, 2021. During the period of soliciting opinions, 79 feedbacks and 108 suggestions were received from all sectors of society, mainly focusing on expanding the scope of application of the notice, establishing a government intention platform, canceling that the model room shall not be set in the buildings that have not been completed and accepted, adding adverse factors, etc.
After analysis and research one by one, Beijing has mainly adopted three suggestions.
1. For the proposal of “increasing adverse factors”, Beijing Municipal Commission of housing and urban rural development partially absorbed and adopted it, and added funeral related contents to the adverse factors.
2. With regard to the suggestion that “project sales should not be suspended when changing sales organizations and salespeople”, considering that it is unreasonable to suspend project sales when changing individual salespeople, this opinion is proposed to be partially adopted.
It is adjusted as follows: when the project is sold, the sales organization and salesperson filed by the development enterprise when applying for the pre-sale license shall organize the sales. If it is necessary to change the sales organization and sales personnel, an application shall be submitted to the competent department of housing and urban rural development where the project is located. If the project changes the sales organization or more than half of the sales personnel, the project sales shall be suspended during the change process.
3. In response to the requirement of canceling the “opinions or suggestions of the buyer on the project quality during the site open day activities, the development enterprise shall timely repair and rectify and feed back to the buyer”, or the suggestion of changing to “timely repair and rectify or explain and feed back to the buyer”, considering that the buyer is not a professional, the opinions and suggestions put forward on the site are not necessarily quality problems, It is proposed to adopt this opinion in part.
The adjustment is as follows: the buyer’s opinions or suggestions on the project quality during the “site open day” activity shall be explained in time, and those belonging to quality defects shall be repaired and rectified in time and fed back to the buyer.
The improved and revised notice still maintains the structure of five parts and 15 articles, including five parts: standardizing the setting of delivery model rooms, standardizing the sales promotion of new commercial housing, implementing the house quality inspection system before delivery, compacting the main responsibility of development enterprises, and others.
Specifically, according to the notice, in terms of setting up the delivery model room, it is particularly clear: first, if the model room set up in the temporary construction within the scope of the project cannot be retained due to the need to be removed due to the completion acceptance, the layout content shall be notarized by a third party. Second, before setting up the delivery model room, the enterprise shall not set up the display (publicity) model room, and the delivery model room, process model area and display (publicity) model room shall be set up in the same place. The display (publicity) model room shall be marked at a prominent position. The indoor decoration and decoration are only used for display.
At the same time, the notice stipulates that the enterprise shall list the list of main materials and equipment in the pre-sale scheme according to the decoration standards agreed in the transfer contract; If a model room is set up during the pre-sale of commercial housing, it shall be delivered according to the house type, size, standard and process specified in the planning drawings and the pre-sale scheme, and the process model area shall be arranged in the delivery model room. Put forward the requirements of “three consistencies”, that is, the decoration standard of the model room shall be consistent with the contents of the list listed in the pre-sale scheme, the delivery standard agreed in the house purchase contract and the actual delivery status of the project, and other decoration and facilities other than the delivery standard shall not be added. At the same time, it is required that the sample room shall be kept until three months after the project delivery.
In terms of the standardization of sales promotion, it is stipulated that when making various sales publicity materials, the display content within the project scope shall be consistent with the planning permission, and the content outside the project shall be consistent with the current situation; Adverse factors of the project shall be publicized in a prominent position on the sales site. Strictly manage the sales organization, personnel and behavior. Before the project sales, the development enterprise shall train the sales personnel, including the basic situation of the project, the content of adverse factors, sales policies and regulations, standardizing promotion terms, etc.
In the process of sales, salespeople should wear badges, and online sales should use their real names. At the same time, it puts forward the “four prohibitions” for salespeople, that is, false and untrue publicity, misleading customers to dispose of public parts, publicizing public service facilities that have not been built around, and promoting sales in a tense atmosphere.
In terms of house quality inspection before delivery, it is stipulated that on the premise of ensuring safety, the enterprise shall carry out “site open days” at least twice before completion acceptance, and organize buyers to enter the project site to understand the field situation of the project. Encourage real-time display of construction progress to buyers through online video.
Emphasize the implementation of the house quality inspection system before delivery. According to the opinions and suggestions put forward by the buyer on the “site open day”, the formal notice clearly stipulates that the development enterprise shall explain in time, and the quality defects shall be repaired and rectified in time and fed back to the buyer.
