Thus, a group of owners represented by Mr. Zheng germinated the idea of establishing a business committee, “We just want to protect the rights and interests of owners.” Mr. Zheng believes that after the establishment of the business committee, can gather greater strength, according to the law to manage the community affairs, protect the rights and interests of the owners, so that the community becomes better and more livable. The rights, responsibilities and obligations of the committee are clearly stipulated in relevant laws and regulations. Article 277 of the Civil Code of the People’s Republic of China, which is about to come into effect, stipulates that owners may set up an owners’ assembly and elect an owners’ committee. The relevant departments of the local people’s governments and residents committees shall give guidance and assistance to the establishment of owners’ congresses and the election of owners’ committees.
The Property Management Ordinance clarifies the establishment process, responsibilities and obligations of the owners’ committee, especially the relationship between the rights and responsibilities between the owners and the property.
